Cancellation & Refund Policy

Bird & Vine Landscaping LLC understands that project plans and schedules may change.

This Cancellation & Refund Policy explains how cancellations, deposits, rescheduling requests, project changes, and refunds are generally handled.

Project-specific terms stated in a signed proposal, estimate, service agreement, work order, or invoice will control if they differ from this policy.

1. Estimate Requests and Consultations

Customers may cancel an estimate request or consultation by contacting us as soon as possible.

If no fee was charged for the consultation, no refund will be necessary.

If a consultation, site evaluation, design service, or other professional service carries a fee, cancellation and refund eligibility may depend on whether the service has already been performed or resources have already been committed.

2. Project Cancellations

Customers who wish to cancel an approved landscaping project should contact Bird & Vine Landscaping LLC as soon as possible.

The amount eligible for refund depends on the stage of the project and the costs already incurred.

3. Deposits

Some projects may require a deposit before scheduling, purchasing materials, or beginning work.

Unless otherwise stated in writing, a deposit may become partially or fully non-refundable once Bird & Vine Landscaping LLC has:

  • Ordered materials

  • Purchased plants

  • Purchased custom or special-order items

  • Reserved equipment

  • Scheduled labor

  • Paid third-party vendors

  • Incurred delivery charges

  • Performed design or planning work

  • Begun site preparation

  • Started the project

Any unused portion of a deposit that has not been applied to incurred costs may be refundable, depending on the applicable project agreement.

4. Custom and Special-Order Materials

Plants, trees, sod, mulch, stone, specialty landscape products, custom materials, and other items purchased specifically for a customer may be non-refundable once ordered.

This is particularly applicable where the supplier does not permit Bird & Vine Landscaping LLC to cancel or return the order.

The customer may remain responsible for the cost of such materials even if the project is later cancelled.

5. Cancellation Before Work Begins

If a customer cancels before onsite work begins, we will review:

  • Materials already purchased

  • Vendor cancellation charges

  • Design or planning work completed

  • Labor or equipment reservations

  • Delivery charges

  • Administrative or project costs already incurred

Any refundable balance will be calculated after these amounts are deducted.

6. Cancellation After Work Begins

Once work has begun, the customer is responsible for:

  • Work already completed

  • Labor already performed

  • Materials purchased or installed

  • Equipment charges

  • Disposal charges

  • Delivery costs

  • Vendor charges

  • Any other reasonable project costs already incurred

If payments made exceed the amount owed for work and costs incurred, the remaining balance may be refunded.

If project costs exceed the payments already made, the customer remains responsible for the outstanding balance.

7. Rescheduling

We understand that customers may occasionally need to reschedule.

Please provide as much notice as possible.

Rescheduling requests are subject to availability.

Repeated rescheduling or last-minute schedule changes may result in additional charges where Bird & Vine Landscaping LLC has incurred labor, equipment, delivery, vendor, or other costs.

8. Weather-Related Rescheduling

Landscaping work may be delayed or rescheduled because of:

  • Rain

  • Severe weather

  • Unsafe temperatures

  • Wet or unsuitable soil conditions

  • Storm conditions

  • Site-access problems

  • Other safety concerns

Weather-related rescheduling initiated by Bird & Vine Landscaping LLC is not considered a customer cancellation.

We will make reasonable efforts to reschedule the affected work.

9. Changes to the Project Scope

Customers may request changes to an approved project.

Requested changes may affect:

  • Pricing

  • Materials

  • Labor requirements

  • Project schedule

  • Completion date

  • Equipment needs

Additional charges may apply.

Where practical, changes will be documented through written approval, revised estimates, invoices, electronic communications, or change orders.

10. Completed Services

Fees for services already completed are generally non-refundable.

If you believe work was not completed according to the agreed scope, please contact us promptly so that we can review the concern.

We may inspect the work and, where appropriate, offer a reasonable corrective solution.

11. Plant and Turf Issues

Plants and turf are living materials and can be affected by weather, watering, pests, disease, soil conditions, wildlife, maintenance, and other factors outside our control.

A refund will not automatically be issued because a plant or turf area later declines or fails.

If a plant warranty or turf warranty applies, the terms of that written warranty will control.

Customers should report concerns promptly and follow any watering or maintenance instructions provided.

12. Maintenance Services

Cancellation terms for recurring maintenance services may be stated in the applicable service agreement.

Customers should provide reasonable notice when cancelling recurring service.

Charges already incurred before cancellation remain due.

13. Refund Processing

Approved refunds will generally be returned through the original payment method where practical.

Processing times may vary depending on the payment provider or financial institution.

Any transaction fees that are non-refundable to Bird & Vine Landscaping LLC may, where permitted and disclosed, be deducted from the refund.

14. Chargebacks and Billing Concerns

If you believe a charge is incorrect, please contact us before initiating a payment dispute or chargeback.

We will make reasonable efforts to review billing concerns and resolve legitimate issues.

A chargeback does not cancel amounts legitimately owed for services, labor, or materials already provided.

15. Exceptions

Bird & Vine Landscaping LLC may make exceptions to this policy at its discretion or where required by applicable law.

Any exception applies only to the specific transaction for which it was granted.
